Kismatio is a technology company incorporated and operating under the laws of India, providing AI-powered astrology consultation services, gemstone recommendations, and related wellness products and services. Registered office and principal place of business: New Delhi, India.

2. Acceptance of Terms

By registering an account, making a payment, initiating a consultation, or otherwise using the Kismatio platform in any capacity, you represent that:

• You are at least 18 years of age.
• You have the legal capacity to enter into binding contracts.
• All information you provide is accurate, current, and complete.
• You have read, understood, and agree to be bound by these Terms, our Privacy Policy, Disclaimer, and Refund Policy, all of which are incorporated herein by reference.

Continued use of the Service following any modification to these Terms constitutes acceptance of the revised Terms.

3. Nature of Services

Kismatio provides the following categories of services and products:

• AI Astrology Consultations — personalised readings, gemstone and rudraksha recommendations, and wellness guidance delivered through our AI-powered astrologer personas (including Jyoti, Nupur, Acharya Vasudev, Dr. Aditi, Adit, Khoji, and Nyaya) via text and voice interfaces.
• Gemstone & Crystal Products — certified gemstones, rudraksha beads, crystals, and related wellness products sold through the platform or recommended by our telecallers.
• Subscription Plans — prepaid time-based or feature-based plans granting access to consultation minutes and premium features.
• Telecaller Consultation Services — human telecaller-assisted consultation scheduling and product recommendation services.

6. Payments & Billing

All financial transactions on the Kismatio platform are processed through PCI-DSS-compliant third-party payment gateways including but not limited to Razorpay, PayU, Cashfree, Stripe, or other authorised payment service providers ("Payment Processors").

• Kismatio does not store, log, or have access to your card numbers, CVV, UPI PINs, net banking credentials, or any other sensitive payment authentication data.
• By initiating a payment, you agree to the terms and privacy policy of the applicable Payment Processor in addition to these Terms.
• All prices are displayed in Indian Rupees (INR) inclusive of applicable taxes unless stated otherwise. International transactions may incur additional fees from your bank.
• Consultation minutes are credited to your account upon successful payment confirmation. Kismatio reserves the right to withhold credit pending fraud verification.
• Subscription plans are prepaid and non-transferable. Unused minutes do not carry over beyond plan validity unless explicitly stated.
• In the event of a failed transaction, contact your bank or payment provider first. Kismatio will not be liable for delays caused by payment network failures outside our control.

7. Refund & Cancellation Policy

Given the nature of AI-driven digital services and personalised consultation content, the following refund terms apply:

• Consultation minutes: Once consultation minutes are consumed, no refund will be issued regardless of user satisfaction with the content of the consultation.
• Unused plan balance: Refund requests for genuinely unused balances due to technical failure on Kismatio's part will be reviewed within 7–10 business days. Approved refunds will be credited to the original payment method within 5–7 business days thereafter.
• Physical products: Damaged or incorrect products may be returned within 7 days of delivery with photographic evidence. Opened gemstones, rudraksha, or crystals are non-returnable unless defective.
• Refunds will not be issued on grounds that astrological predictions, gemstone recommendations, or spiritual guidance did not produce expected outcomes.
• To initiate a refund, email care@gemtre.in with your registered mobile number, order/transaction ID, and reason. Kismatio reserves the right to accept or reject refund requests at its sole discretion.

8. Privacy Policy — Data Collection

We collect the following personal data:

• Identity & Contact — name, mobile number, email address, date of birth, time and place of birth, gender.
• Consultation Data — chat history, voice session logs (not permanently stored), questions asked, responses generated.
• Transaction Data — payment references, order IDs, plan purchases, and transaction status.
• Technical Data — IP address, device type, operating system, browser, app version, and session metadata.
• Location Data — birth place (for chart calculation) and approximate current location if voluntarily provided.

9. How We Use Your Data

• To generate personalised AI astrology consultations, birth charts, and recommendations.
• To process transactions and manage your account balance and plan.
• To deliver physical products to your address.
• To send service, support, and transactional communications via WhatsApp, SMS, or email.
• To improve AI model accuracy and platform performance using anonymised, aggregated data.
• To detect, investigate, and prevent fraud, abuse, or security incidents.
• To comply with applicable Indian laws, court orders, and regulatory requirements.

10. Data Sharing & Third Parties

We do not sell your personal data. Data may be shared with:

• Infrastructure & AI Partners — Supabase (database), Google Firebase (authentication), Vercel (hosting), OpenAI / Anthropic (AI inference), ElevenLabs (voice synthesis). All operate under data processing agreements and handle data solely to provide services on our behalf.
• Payment Processors — Razorpay, PayU, Cashfree, Stripe or other processors, solely to complete financial transactions.
• Logistics Partners — for physical product delivery, your name, phone, and shipping address are shared with courier partners.
• Legal & Regulatory Authorities — when required by applicable law, court order, or governmental authority.

11. Data Retention & Security

Account and consultation data is retained for as long as your account is active and for a minimum of 3 years thereafter for legal and compliance purposes, unless deletion is requested and legally permissible. Voice audio is discarded at session end.

We implement HTTPS encryption, row-level security in our database, HMAC-signed tokens, and strict access controls. No transmission method is 100% secure; while we take all reasonable precautions, Kismatio cannot guarantee absolute security of your data.

12. Cookies & Tracking

We use session cookies and local storage for authentication and preferences. We do not deploy third-party advertising trackers. Analytics data is collected in aggregate, non-personally-identifiable form only.

13. User Conduct & Prohibited Uses

You agree not to:

• Use the platform for any unlawful, fraudulent, or harmful purpose.
• Attempt to reverse-engineer, scrape, clone, or misappropriate Kismatio's AI models, data, or platform.
• Share your account credentials, transfer plan minutes, or resell consultation access.
• Submit false, misleading, or defamatory content through any channel.
• Harass, abuse, or threaten Kismatio staff, telecallers, or other users.
• Attempt to exploit payment processing systems through chargebacks without valid cause.

Violation may result in immediate account suspension without refund and legal action at Kismatio's sole discretion.

15. Indemnification

You agree to indemnify, defend, and hold harmless Kismatio and its directors, officers, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:

• Your use of or inability to use the Service.
• Your violation of these Terms or any applicable law or regulation.
• Your infringement of any intellectual property or other rights of any third party.
• Any false, misleading, or inaccurate information you provide.
• Any dispute between you and a third party in connection with the Service.

16. Intellectual Property

All content on the Kismatio platform — including the AI models, software, UI design, consultation outputs, brand names, logos, written content, and data compilations — is the exclusive intellectual property of Kismatio and is protected under applicable Indian and international copyright, trademark, and IP laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the platform solely for personal, non-commercial purposes in accordance with these Terms. No licence is granted for any other purpose.

17. Minors

The Service is strictly for users aged 18 and above. If you are below 18, you must not use this Service. If Kismatio becomes aware that a minor has registered or made a payment, the account will be terminated and any applicable refund processed. Parents or guardians who discover unauthorised use by a minor must contact us immediately.

19. Grievance Redressal

In accordance with the Information Technology Act 2000 and the Consumer Protection (E-Commerce) Rules 2020, any complaints or grievances relating to the Service may be directed to our Grievance Officer:

Kismatio's internal grievance process must be exhausted before approaching any external authority or court, except where prohibited by law.

20. Changes to These Terms

Kismatio reserves the right to modify, update, or replace these Terms at any time without prior individual notice. Changes are effective upon posting to this page with an updated date. Your continued use of the Service after any modification constitutes your unconditional acceptance of the revised Terms. It is your responsibility to review this page periodically.

21. Severability & Entire Agreement

If any provision of these Terms is found invalid, unlawful, or unenforceable by a competent court, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy and any additional policies or agreements referenced herein, constitute the entire agreement between you and Kismatio with respect to the Service and supersede all prior or contemporaneous communications and proposals.
